The content of law in the era of new technologies
Abstract
Background. The rapid development of digital technologies determines a profound transformation of the content of law as a fundamental legal category. The purpose of the study is to analyze the nature and orientation of this transformation at three structural levels of the legal content and identify systemic problems of legal regulation in the new conditions. Materials and methods. The re-search is based on the application of system-structural and formal legal methods, which allowed us to consider law as a multilevel system. Comparative legal and historical legal analysis were used to solve particular problems. The materials were scientific publications on the problems of legal digitalization, regulatory legal acts of the Russian Federation, as well as empirical data reflecting discussions in the professional community. Results. It has been established that new rights, duties, and types of legal personality are being formed at the special legal level, but their consolidation is asymmetric and fragmented. At the intellectual and volitional level, the delay in the reaction of the state will to technological challenges has been revealed. At the socio-political level, it has been confirmed that technology creates risks of digital inequality and new threats while increasing convenience and accessibility of services. Conclusions. It is concluded that there is a systemic contradiction between the dynamics of public relations generated by digitalization and the inertia of the three-level structure of the content of law. Its resolution requires a balanced approach by the legislator, including the simultaneous consolidation of digital rights and obligations, the development of guarantees and the preservation of alternative (non-digital) ways of exercising rights.
