Die Entwicklung der Gerichtszuständigkeiten im Lauterkeitsrecht
Abstract
This book provides a systematic classification of jurisdictional rules in unfair competition law in the context of advancing digitalisation. It demonstrates how the development and significance of the 'floating jurisdiction' principle under the Unfair Competition Act (UWG) can be traced and integrated into modern procedural laws. Building on an analysis of the UWG 1896, the book examines key reforms of competition procedural laws and the associated jurisdictional issues. A key focus is on the assessment of these issues in the light of current legislation and the increasing digitalisation of civil procedure law. The study combines legal-theoretical analysis with a practice-oriented perspective and is aimed at both academia and practitioners.
