A nemzetközi jog hatása a magánjogra - elmosódott határvonal?
Abstract
The study examines the interaction between international public law and private law through the examples of state immunity, the codification of private international law, the right of access to court and international investment protection. It argues that the classical distinction between "public law" and "private law" becomes functionally blurred in several respects due to globalized legal relations and the spread of fundamental rights standards. International public law norms acquire direct relevance within domestic private law relations, while private law logic and remedial patterns (especially in labour disputes) influence the development of international public law. Based on the Hungarian experience in application of these legal measures, the study identifies typical points of conflict and proposes measures to strengthen interpretative and institutional coherence.
