The Trinity of Philosophical Projections That Determine the Conceptualization of the Fulfillment of Civil Obligations
Abstract
the fulfillment of civil law obligations in the context of new digital realities re-quires significant scientific and practical reflection. At the same time, digital trends, which can be observed both in Russian legal policy and in legislation, should be evaluated not in isolation, but through the lens of three philosophical projections that determine conceptualization: ontology, epistemology, and axiol-ogy. The article notes that empirical and theoretical data about an object require their synchronization through a certain coordinate system, one of which is the philosophical and worldview paradigm that has become popular in legal research. The author emphasizes that studying the fulfillment of civil law obligations through the lens of ontological foundations involves identifying the basic determi-nants that have led to the emergence of this phenomenon in legal reality. In turn, the epistemological prerequisites for the knowledge of the performance of civil law obligations are nothing more than the accumulated system of knowledge, ideas, and theoretical judgments about the phenomenon being studied. In the con-text of this research, axiological etiology refers to the value factor that determines the modernization of the current legal regulation in the field of civil law obliga-tions. The general conclusion is that understanding the trinity of philosophical pro-jections that determine the conceptualization of the fulfillment of civil law obliga-tions will not only provide insight into the emerging digital novelties, but also allow for the prediction of their likely trends.
