К ВОПРОСУ О НОВОМ ПОРЯДКЕ КАССАЦИОННОГО ОБЖАЛОВАНИЯ СУДЕБНЫХ АКТОВ МИРОВЫХ СУДЕЙ ПО УГОЛОВНЫМ ДЕЛАМ
Abstract
Статья посвящена законодательным изменениям порядка кассационного обжалования итоговых судебных решений мировых судей, произошедших в апреле 2026 г. по инициативе Верховного суда Российской Федерации. На основе анализа содержания проведенной реформы и материалов судебной практики и статистики авторами формулируются цели, которые были поставлены перед законодателем в ходе внесения соответствующих изменений в процессуальное законодательство. Особое внимание уделяется обновленному порядку кассационного обжалования решений мировых судей по уголовным делам, который отныне предполагает существование фильтрующего этапа. Доказывается, что реформа института кассационного обжалования решений мировых судей преследовала комплексную цель по расширению процессуальных гарантий участвующих в деле лиц за счет обеспечения им большего доступа в кассационную инстанцию, а также по снижению нагрузки на судей вышестоящих судов. С учетом правовых позиций Конституционного суда Российской Федерации, а также международных и зарубежных подходов к построению кассационного производства авторами формулируются выводы о том, что новый порядок обжалования вступивших в законную силу судебных актов мировых судей не приведет к снижению уровня судебной защиты граждан Российской Федерации. The article is devoted to the legislative changes in the procedure for cassation appeal of final court decisions by magistrates, which took place in April 2026 at the initiative of the Supreme Court of the Russian Federation. Based on the analysis of the content of the reform and materials from judicial practice and statistics, the authors formulate the goals that were set for the legislator during the relevant changes to procedural legislation. Special attention is given to the updated procedure for cassation appeal of decisions by magistrates in criminal cases, which now includes a filtering stage. It is proved that the reform of the institution of cassation review of magistrate judges' decisions pursued a comprehensive goal of expanding the procedural guarantees for the parties involved in the case by providing them with greater access to the cassation court, as well as reducing the workload on judges of higher courts. Taking into account the legal positions of the Constitutional Court of the Russian Federation, as well as international and foreign approaches to the construction of cassation proceedings, the authors conclude that the new procedure for appealing against the judgment of magistrate judges that has entered into force will not lead to a decrease in the level of judicial protection for citizens of the Russian Federation.
