Peran Mediasi dalam Menjaga Ketahanan Keluarga dari Fenomena Perceraian di Kota Baubau: Perspektif Hukum Keluarga Islam
Abstract
Divorce is a family issue that affects marital continuity, the fulfillment of children's rights, and family social resilience. This study aims to analyze family resilience in addressing the phenomenon of divorce in Baubau City from the perspective of Islamic Family Law. The study employs an empirical legal method with a juridical-sociological approach. Data were collected through interviews, observations, documentation, and a review of marriage laws and Islamic Family Law principles. The findings indicate that weak family resilience is influenced by economic problems, ineffective communication, marital conflicts, inadequate fulfillment of spouses' rights and obligations, and social changes. From the perspective of Islamic Family Law, family resilience is an essential element in establishing a sakinah, mawaddah, wa rahmah family. Strengthening communication, fulfilling marital rights and obligations, premarital education, family guidance, and optimizing mediation are necessary preventive measures to reduce divorce in Baubau City
