Зарубежный конституционный опыт формализации воспитания личности

Abstract

в условиях усиления внимания к вопросам духовно-нравственного становления личности в современном правовом государстве возрастает значимость конституционно-правовых основ воспитания. Актуальность темы обусловлена необходимостью выявления универсальных и национально-специфических подходов к формализации воспитания в конституционных актах зарубежных стран, что позволяет обогатить российскую доктрину и законодательную практику. Целью статьи является сравнительно-правовой анализ конституционных норм европейских государств и стран Содружества независимых государств, посвященных воспитанию личности. В ходе исследования установлено, что в большинстве конституций воспитание закреплено как совокупное право и обязанность родителей, при этом государство выступает гарантом поддержки семьи, обеспечения языкового и культурного разнообразия, а также защиты прав уязвимых категорий детей. Особое внимание уделено децентрализации компетенций в сфере воспитания и его интеграции в различные сферы политики – от молодежной до уголовно-исполнительной. Выявлены оригинальные конституционные нормы, связывающие воспитание с профессиональной этикой, борьбой с социальными пороками и признанием особой роли педагога. Обоснован вывод о том, что воспитание в зарубежных конституциях выступает публично-значимой функцией государства, реализуемой на различных уровнях власти. in the context of increased attention to the issues of spiritual and moral development of the individual in a modern legal state, the importance of the constitutional and legal foundations of education is growing. The relevance of this topic is due to the need to identify universal and national-specific approaches to the formalization of education in the constitutional acts of foreign countries, which allows us to enrich the Russian doctrine and legislative practice. The purpose of this article is to conduct a comparative legal analysis of the constitutional norms of European countries and the Commonwealth of Independent States regarding the education of the individual. The study found that most constitutions enshrine education as a collective right and duty of parents, with the state acting as a guarantor of family support, ensuring linguistic and cultural diversity, and protecting the rights of vulnerable children. Special attention is given to the decentralization of education competencies and their integration into various policy areas, from youth policy to penal policy. The study identified original constitutional norms that link education to professional ethics, the fight against social vices, and the recognition of the special role of educators. The conclusion is substantiated that education in foreign constitutions is a publicly significant function of the state, implemented at various levels of government.
