Maqashid Syariah dalam Kebijakan Upah Minimum Provinsi Banten: Tinjauan Terhadap Stabilitas Ekonomi Rumah Tangga dan Tren Perceraian di Pengadilan Agama Banten
Abstract
The minimum wage policy in Banten Province is a state instrument in protecting workers' economic rights and supporting the fulfillment of decent living needs. From a maqashid sharia perspective, this policy is related to the principles of hifz al-mal (protection of assets) and hifz al-nasl (protection of offspring/family). This research aims to analyze the Banten Provincial Minimum Wage (UMP) policy based on the principles of hifz al-mal and hifz al-nasl and normatively analyze its relationship with household economic conditions and the divorce phenomenon in Banten Province. The research uses normative juridical methods with statutory, conceptual and case approaches, and is supported by secondary data in the form of reports from the Religious Court and the Banten High Religious Court. The research results show that the gap between the nominal UMP and decent living needs can be seen as an economic protection issue from the hifz al-mal perspective. This condition is conceptually related to the family's ability to fulfill basic needs as part of hifz al-nasl. Religious court data shows that economic factors are listed as one of the reasons for divorce. However, this research does not prove a causal relationship between the UMP gap and divorce. A fair and problem-oriented wage policy is needed to strengthen economic and family resilience in Banten Province.
