PERTIMBANGAN HUKUM HAKIM DALAM PERKARA TINDAK PIDANA LINGKUNGAN HIDUP
Abstract
Penelitian ini bertujuan untuk menganalisis konstruksi hukum dan pertimbangan hakim dalam memutus perkara tindak pidana lingkungan hidup pada Putusan Nomor 748/Pid.Sus-LH/2024/PN Mks. Perkara tersebut berkaitan dengan penguasaan serta perakitan bahan peledak yang berpotensi digunakan untuk penangkapan ikan secara ilegal dan berisiko merusak ekosistem laut. Penelitian ini merupakan penelitian hukum normatif dengan pendekatan perundang-undangan dan pendekatan kasus, yang difokuskan pada penelaahan norma hukum serta penerapannya dalam putusan pengadilan. Hasil kajian menunjukkan bahwa pembuktian didasarkan pada alat bukti yang sah sesuai Pasal 184 KUHAP, meliputi keterangan saksi, ahli, surat, barang bukti, dan keterangan terdakwa, yang secara keseluruhan membentuk keyakinan hakim. Dalam pertimbangan yuridisnya, hakim menilai bahwa unsur tindak pidana telah terpenuhi berdasarkan Pasal 1 ayat (1) Undang-Undang Darurat Nomor 12 Tahun 1951. Penjatuhan pidana mempertimbangkan tingkat kesalahan terdakwa, potensi dampak terhadap lingkungan laut, serta tujuan pemidanaan yang mengedepankan efek jera. Putusan ini mencerminkan penerapan asas kepastian hukum, keadilan, dan kemanfaatan dalam penegakan hukum pidana lingkungan. This study aims to examine the juridical construction and judicial considerations underlying the decision in environmental crime case Number 748/Pid.Sus-LH/2024/PN Mks. The case concerns the possession and assembly of explosive materials allegedly intended for illegal fishing activities, which pose a serious threat to marine ecosystems. This research employs a normative legal method using both statutory and case approaches to analyze the applicable legal provisions and their implementation in the court’s decision. The findings indicate that the evidentiary process was based on legally recognized forms of evidence pursuant to Article 184 of the Indonesian Criminal Procedure Code, including witness testimony, expert testimony, documentary evidence, physical evidence, and the defendant’s statement. Collectively, these elements formed the basis of the judge’s conviction. From a juridical perspective, the court determined that the elements of the criminal offense were fulfilled under Article 1 paragraph (1) of Emergency Law Number 12 of 1951. In imposing the sentence, the judges considered the degree of the defendant’s culpability, the potential environmental impact of the act, and the objectives of punishment, particularly the deterrent effect. Overall, the decision reflects the application of the principles of legal certainty, justice, and expediency in the enforcement of environmental criminal law.
