FRAME STRUCTURING AS A METHOD OF CRIMINAL PROCEDURAL PROOF
Abstract
The purpose of this study is to analyze the legal nature, structure, and functional capabilities of frame structuring as an instrument for the construction and evaluation of evidence in criminal proceedings, taking into account contemporary theoretical and legal approaches to proof. In this context, the objective is to organize evidentiary information through frame structuring in the form of a cognitive construct that enables the systematic formation of a comprehensive evidentiary base by comparing facts and identifying contradictions. The methodological foundation of the research consists of the general didactic method of cognition of objective reality, methods of analysis and synthesis, modeling, the formal-legal method, the method of frame structuring, as well as the analysis of current legislation and scholarly sources. Such an integrated approach ensures the integrity and objectivity of the study. The results of the research demonstrate a synthesis of legal requirements and the internal conviction of the proving subject in the evaluation of evidence, and also reveal the interdisciplinary nature of framing. It is concluded that the modern Kazakhstani model of the institution of criminal procedural proof is suitable for the frame structuring of the results of various investigative actions for its effective implementation as a method of criminal procedural proof. Its implementation will optimize the process of collecting evidentiary information, its analysis and legal assessment, and its effective use in the process of proof. The advantages of this method of cognition, in the near future, lie in its potential correlation with the development of artificial intelligence systems.
