Abstract

In contrast to the spectrum nature of decision-making capacity, the Hungarian system of adult guardianship continues to rely on a fundamentally binary logic, resulting in systemic dysfunctions. The predominance of guardianship and the limited practical relevance of supported decision-making mechanisms create a legal "grey zone" that simultaneously restricts the autonomy of the persons concerned and undermines the security of legal transactions. Based on domestic practice and comparative examples, the study argues that reducing substitute decision-making and strengthening flexible, decision-specific forms of support is not only a matter of fundamental rights, but also a requirement of systemic functionality and an economic necessity.
