Abstract

This study presents the types of settlements that can be entered into during probate proceedings, as well as substantive and procedural law rules, while also examining the parties eligible to enter into such settlements. The analysis discusses the types of settlements in detail, paying special attention to the specific rules concerning agricultural land. It analyzes the rules for the redemption of the surviving spouse's right of usufruct under both the former and the current Civil Code. Finally, it outlines the formal requirements for notarial approval of settlements, emphasizing their role in preventing legal disputes and reducing the workload of the courts.
