Abstract
The decision to remain childfree is increasingly becoming a prominent discussion in Indonesia, gradually reshaping public perception of the ideal family structure. This study aims to examine the childfree phenomenon through the lens of shifts in socio-economic values and how Islamic law responds to it using the principles of al-adah al-muhakkamah and maqashid syariah. Using a library research method, this study analyzes relevant academic literature, religious texts, and legal regulations. The findings reveal that this phenomenon is driven by a shift in the younger generation's mindset, which prioritizes financial readiness, mental health, and personal freedom—thereby challenging the traditional belief that "more children bring more fortune." From an Islamic jurisprudence perspective, childfree cannot be permanently legalized through customary practices (al-adah al-muhakkamah) as it directly contradicts the primary purpose of marriage in maqashid syariah, namely the preservation of lineage (hifdz an-nasl). Generally deemed makruh or haram if motivated by fear of poverty or selfishness, it may become permissible (mubah) in cases of medical emergencies or life safety (hifdz an-nafs). This study highlights the importance of distinguishing voluntary childfree decisions from involuntary childlessness to prevent unjust social stigmatization.
